Data Protection Declaration

Introduction

As the operator of this website, we, Ninkaplast GmbH, are the responsible party for the processing of the personal data of the user of this website. You will find our contact data in the legal notice of the website; the contact person for questions regarding the processing of personal data is named directly in this privacy statement.

We take the protection of your privacy and private data very seriously. We collect, store and use your personal data only in agreement with the contents of this privacy statement and the applicable data protection regulations, especially the European General Data Protection Regulation (GDPR) and national data protection provisions.

With this privacy statement, we would like to inform you about the extent to and purpose for which the personal data is processed in conjunction with the utilisation of the website.

Personal data

Personal data is information that refers to an identified or identifiable individual. This includes all information on your identity such as your name, e-mail address or postal address. Information that cannot be associated with your identity (such as statistical information like the number of users of the website), on the other hand, is not considered to be personal information.

You can fundamentally use our website without disclosing your identity or specifying personal data. We therefore only collect general information about the visit to our website. For some of the available services, however, we collect your personal data. We fundamentally only process this data for the purpose of the use of this website, especially for the processing of the desired information. When personal data is collected, only the data that is absolutely mandatory must be collected. In additional, further information may be possible, but the provision of this information is voluntary. Please note that the pertinent fields will be mandatory or voluntary. We will provide you with concrete details in the corresponding section of this policy statement.

An automatic decision-making process based on your personal data is not performed within the context of the utilisation of our website.

Processing of personal data

We store your information on specially protected servers within the European Union. These servers are protected against loss, destruction, access and changes in or distribution of your data by unauthorised persons by technical and organisational measures. Only a few authorised persons may access your data. These persons are responsible for the technical, commercial or editorial maintenance of the servers. Despite regular monitoring, a complete protection against all risks, however, is not possible.

The transmission of our websites and any entries you make on our websites through the Internet fundamentally takes place in an unencrypted manner. The risk of third parties viewing and/or accessing the transferred data can therefore not be excluded. We recommend that you take this aspect into consideration for your decision as to whether and which data is sent to us through the Internet.

Disclosure of personal data to third parties

We basically use your personal information to render the services you desire. If we use external service providers to render the service, these service providers also access the data only for the purpose of rendering the service. Through technical and organisational measures, we guarantee the observance of data protection regulations and oblige our external service providers to do so as well.

In addition, we do not disclose your data to third parties without your express consent, especially not for advertising purposes. Your data is disclosed only if you yourself have consented to the data being disclosed or insofar as we are authorised or obliged to disclose this information due to legal regulations and/or the requirements of public authorities or by court order. In particular, such situations can include the provision of information for the purpose of criminal prosecution, hazard prevention or the assertion of intellectual property rights.

Insofar as we obtain consent for the processing of your personal data, Art. 6 Sect. 1 lit. a) GDPR as the legal basis for data processing.

Insofar as we process your personal data because this processing is required for the fulfilment of a contract or within the scope of a quasi-contractual relationship with you, Art. 6 Sect. 1 lit. b) GDPR is the legal basis for data processing.

Insofar as we obtain consent for the processing of your personal data for the fulfilment of a legal obligation, Art. 6 Sect. 1 lit. c) GDPR as the legal basis for data processing.

As a legal basis for data processing, Art. 6 Sect. 1 lit. f) DGPR is also taken into account if the processing of your personal data is required to safeguard a legitimate interest of our company or a third party and if your interests, basic rights and basic freedoms not require the protection of your personal data in the pertinent context.

Within the scope of this privacy statement, we always refer to the applicable legal basis on which we support the processing of your personal data.

Data deletion and storage duration

We delete and/or block your personal data whenever the purpose of storage no longer applies. Furthermore, storage can take place only as provided for by legal requirements to which we are subject, for example, in regard to legal storage and documentation obligations. In such cases, we delete and/or block your personal data when the corresponding requirements have expired.

Utilisation of our website

Information about your computer

For each access of our website, we collect information on your computer independently of your registration, such as the IP address of your computer, the browser query and the time of this query. In addition, the status and transferred data volume within the scope of this query are collected. We also collect product and version information on the browser used and the operating system of your computer. In addition, we collect information on the website from which access to the website was established. In the process, the IP address of your computer is saved only for the period of time of the use of the website and then deleted or anonymised by abbreviation after this use. The other data is saved for a limited period of time.

We use this data for the operation of the website, especially to determine and eliminate faults, to determine the utilization of the website and to make adaptations or improvements. The abovementioned purposes are also the basis of our legitimate interest in data processing according to Art. 6 Sect. 1 lit. f) GDPR, which is also the legal basis of this data processing.

Google Maps

In our website, we use the Google Maps map service through an interface. Google Maps is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94034, USA ("Google").

To use the functions of Google Maps, your IP address must be stored. This information is generally sent to a Google server in the United States and stored there. The provider of this website has no influence on this data transmission.

We use Google Maps to help you find our locations specified in our website more easily. This use constitutes a legitimate interest within the scope of Art. 6 Sect. 1 lit. f) GDPR, which is simultaneously the legal basis for the use of Google Maps.

Additional information on the handling of user data can be found in the data protection declaration of Google under: https://www.google.de/intl/de/policies/privacy/.

Use of cookies

Cookies are used for our website, as is the case for many websites. Cookies are small text files that are stored on your computer. They save certain settings and data in order to exchange with our website through your browser. A cookie generally contains the name of the domain from which the cookie file was sent, as well as information on the age of the cookie and an alphanumerical identification code.

Cookies enable us to recognise your computer and make any presettings available to you immediately. Cookies help us improve the website and provide you with better service that is even more tailored to your needs. This also constitutes our legitimate interest in data processing according to Art. 6 Sect. 1 lit. f) GDPR.

The cookies we use are so-called session cookies, which are deleted again automatically at the end of the browser session. In individual cases, cookies with a longer storage duration can be used so that your presettings and preference can still be taken into consideration at the next visit of our website.

Most browsers are set in such a way that they automatically accept cookies. You can deactivate the saving of cookies, however, or set your browser so that it notifies you as soon as cookies are sent. You can also manually delete previously saved cookies through the browser settings. Please note that you might be able use our website only with limitations or even not at all if you reject the saving of cookies or delete necessary cookies.

Technically required cookies

Some cookies are technically required to enable your use of our website. We collect and save the following data with these cookies:

-          Language settings

-          Search settings

-          Content of an online form

Cookies enable us to recognise your computer and make any presettings available immediately. Cookies help us improve the website and provide you with better, user-friendly service. The use of the cookies is also required to simplify the use of our website for you. Some functions can be provided only with the use of cookies. This also constitutes our legitimate interest for the legal basis of the processing of data using cookies according to Art. 6 Sect. 1 lit. f) GDPR.

Applications

We inform you about our job vacancies under the "Career" category. You can send us your application by e-mail or post.

At the receipt of an application, your documents will be sent to our responsible employees electronically. If you have applied to an advertised position, the documents are deleted automatically for six months after the conclusion of the hiring process insofar as a deletion does not contradict other legitimate interests. Such legitimate interests in this context, for example, include the burden of proof in court proceedings according to the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz (AGG)). In case of an application without reference to an explicitly advertised position (unsolicited application), the application is kept for as long as the application is of interest. At any time, you can request the deletion of your application before the provided retention period has expired. In case of a successful application, the data transmitted for the purpose of the settlement of the employment relationship will be stored under the observance of legal requirements. In all other cases, the legal basis for the storage of your application data is your consent according to Art. 6 Sect. 1 lit. a) GDPR.

Communication with our company

You can contact us in a variety of ways, including the contact form on our website.

Contact form

Insofar as you would like to use the contact form for the evaluation of our products on our website, we collect the personal data you enter in the contact form, especially your name and e-mail address, for this purpose. In addition, we save the IP address, as well as the date and time of the inquiry. We process the data sent using the form only for the purpose of answering your inquiry and/or concern.

You can decide for yourself which information you send through the contact form. The legal basis for the processing of the data is your consent according to Art. 6 Sect. 1 lit. a) GDPR.

After our processing of the matter, the data will initially be stored in case of any inquiries. A deletion of the data can be requested at any time; otherwise, the data is deleted after the final settlement of the matter. Any legal retention periods remain unaffected.

Your rights and contact

We greatly value explaining the processing of your personal data to you as transparently as possible and informing you about your rights due to you. If you desire more detailed information or if you wish to exert the rights due to you, you can contact us at any time so that we can take care of your concern.

Rights of the person affected

In regard to the processing of your personal data, you have the extensive rights. Firstly, you have a comprehensive right to information and can also demand the correction and/or deletion or blocking of your personal data. You can also request a limitation of processing and have a right to objection. In regard to the personal data you send us, you also have a right to data transferability.

If you would like to assert one of your rights and/or obtain more information about a right, please contact our Customer Service. Alternatively, you can also contact our data protection officer.

Revocation of consent and objection

Consent that you have granted in the past can be freely revoked at any time with future effect. Through the revocation of consent, the legality of any processing performed up to the point in time of the revocation of consent is not affected. The contact person for this procedure is our data protection officer.

Insofar as the processing of your personal data is not based on your consent, but rather on another legal basis, you can object to this processing of your data. Your objection leads to an investigation and to the termination of the data processing if pertinent. You will be informed about the result of the investigation and receive – if the data processing shall continue nevertheless – more detailed information on why the processing of your data is permissible.

Data protection officer and contact

We have appointed an external data protection officer who supports us in regard to data protection topics. You can contact him directly. Our data protection officer and his team are gladly available to you for questions regarding our handling of personal data or additional information on data protection topics:

Complaints

If you believe that our processing of your personal data is not in compliance with this privacy statement or the applicable data protection provisions, you can complain to our data protection officer. The data protection officer will then investigate the matter and inform you about the result of the investigation. In addition, you have the right to complain to the responsible supervisory body.
